Welcome to Eaglever ("we," "us," or "our"). This Terms of Sale and Privacy Policy (the "Policy") combines the specific terms for your ("User" or "you") merchandise purchases on the Eaglever Service with our practices for collecting, using, and protecting your information. By using the Eaglever website and services (the "Service"), you agree to this Policy and our Terms of Service.
Important: This Policy is governed by U.S. law. We comply with applicable U.S. data privacy laws, including the California Consumer Privacy Act (CCPA) and other state-specific privacy regulations. It does not cover employee or job applicant information. If you access the Service from outside the U.S., you acknowledge that your information may be transferred to and processed in the U.S., and you consent to such transfer in accordance with the "International Data Transfers" provisions below.

When you interact with the Service, we automatically collect certain data using cookies, web beacons, and similar tracking technologies. This includes:

- Analytical cookies: Used to analyze Service usage, improve performance, and optimize the user experience (e.g., tracking which pages are most visited). These can be disabled in your browser settings.
We do not use advertising cookies for targeted advertising without your explicit consent. Third-party cookies (e.g., from our analytics provider Google Analytics) may be used in accordance with their privacy policies, and you can manage or disable these via your browser settings.
2. How We Use Your Information
We use your personal information only for legitimate business purposes consistent with this Policy, including:
- Fulfillment of orders: Process payments, arrange shipping, and deliver merchandise to you.
- Communication: Respond to your inquiries, send order confirmations, shipping notifications, and updates about your account or the Service.
- Service improvement: Analyze usage data to enhance the Service’s functionality, performance, and user experience (e.g., optimizing website navigation, adding new features).

- Legal compliance: Comply with applicable laws, regulations, legal processes, or enforceable governmental requests (e.g., subpoenas, court orders).
- Internal operations: Conduct data analysis, audits, and other internal business activities to ensure the efficiency and effectiveness of our operations.
3. How We Share Your Information
We do not sell your personal information to third parties for marketing purposes, except as required by law. We share your information only in the following limited circumstances, and only with parties that agree to protect your data in accordance with this Policy and applicable law:
Service Providers
We share your information with third-party vendors and service providers that perform services on our behalf, including:
- Payment processors: To process payments securely (as described in Part 1, Section 1).
- Shipping and logistics partners: To deliver your orders and provide shipping updates (e.g., FedEx, UPS).
- Analytics providers: To analyze Service usage and improve our offerings (e.g., Google Analytics).
- Customer service tools: To manage and respond to your inquiries (e.g., helpdesk software providers).
All such service providers are contractually obligated to use your information only to perform the services we request, maintain appropriate security measures, and not disclose or use your information for any other purpose.
Legal Requirements
We may disclose your information if required to do so by law, regulation, legal process, or enforceable governmental request (e.g., from a court, law enforcement agency, or regulatory authority). We may also disclose your information to protect our rights, privacy, safety, or property, or that of our users, employees, or the public (e.g., to investigate fraud, respond to a security breach, or enforce our Terms of Service).
Business Transfers
In the event of a merger, acquisition, sale of all or substantially all of our assets, reorganization, liquidation, or other business transfer (e.g., bankruptcy), your personal information may be transferred to the acquiring or successor entity as part of the transaction. The acquiring entity will be bound by the terms of this Policy, or a similar privacy policy that provides equivalent protection for your information.
Consent
We may share your information with third parties if you have given us explicit consent to do so (e.g., sharing your shipping information with a third-party gift recipient).
4. Data Security & Retention
Data Security
We implement reasonable technical, administrative, and physical security measures designed to protect your personal information from unauthorized access, use, disclosure, alteration, or destruction. These measures include:
- Encryption of data in transit (via SSL/TLS) and at rest (using industry-standard encryption protocols).
- Access controls limiting access to personal information to authorized employees and service providers only.
- Regular security audits, vulnerability assessments, and employee training on data protection best practices.
However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee the absolute security of your information, and you acknowledge that you provide your information at your own risk. If we become aware of a data breach that affects your personal information, we will notify you and relevant authorities in accordance with applicable law (e.g., CCPA’s breach notification requirements).
Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law (e.g., tax, accounting, or legal obligations). The retention period for each category of information is determined based on the following:
- Order-related data (e.g., purchase history, shipping information): Retained for 3 years after the order is completed, unless a longer retention period is required by law (e.g., tax record retention requirements).
- Account information: Retained for as long as your account is active, or for 3 years after your account is deactivated (whichever is longer), unless required by law to retain it for a longer period.
- Marketing-related data: Retained for 6 months after you opt out of marketing communications, unless required by law to retain it for a longer period.
- Customer service communications: Retained for 2 years after the last communication, to address any follow-up inquiries or disputes.
When your information is no longer needed, we will securely delete or anonymize it (so that it can no longer identify you) in accordance with our data retention and destruction policies. If anonymization is not feasible (e.g., due to technical constraints), we will store the information securely and restrict access to it until deletion is possible.
5. International Data Transfers
If you access the Service from outside the U.S., your personal information may be transferred to and processed in the U.S. or other countries where our service providers are located. Some of these countries may have data protection laws that are different from those in your country of residence (and may not provide the same level of protection). We ensure that all international transfers of your information comply with applicable data privacy laws, including:
- Using Standard Contractual Clauses (SCCs) approved by the European Commission (if transferring to the EEA or other regions that recognize SCCs) or other legally valid transfer mechanisms.
- Ensuring that our service providers located outside the U.S. maintain appropriate security measures and comply with this Policy and applicable data protection laws.
- Notifying you of the international transfer and the protection mechanisms in place (as required by law).
You have the right to request information about the international transfer of your data, including the countries to which your data is transferred, the purpose of the transfer, and the protection mechanisms used. To exercise this right, please contact us using the information provided in Section 9.
6. Your Rights & Choices
Marketing Choices
You may opt out of receiving promotional marketing emails at any time by clicking the "unsubscribe" link in the email or by contacting us at customer@eaglever.com. We will process your opt-out request within 10 business days. Please note that even if you opt out of marketing communications, we may still send you service-related messages (e.g., order confirmations, shipping notifications, account updates), which are necessary for the provision of the Service and cannot be opted out of.
Privacy Rights
Depending on your location (e.g., California under the CCPA, or other U.S. states with privacy laws), you may have the following rights with respect to your personal information:
- Right to access: Request a copy of the personal information we hold about you.
- Right to correction: Request that we correct inaccurate or incomplete personal information.
- Right to deletion: Request that we delete your personal information (subject to exceptions, such as legal obligations or legitimate business purposes).
- Right to data portability: Request that we provide your personal information in a structured, machine-readable format (if applicable under your local law).
- Right to opt out of certain data sharing: Opt out of the disclosure of your personal information to third parties for their own marketing purposes (if applicable).
Exercising Your Rights
To exercise any of the above rights, please contact us at customer@eaglever.com with your full name, email address associated with your account, and a detailed description of your request. We will verify your identity before processing your request (e.g., by asking you to confirm information associated with your account). We will respond to your request within 30 business days of receiving it. If we need more time to process your request (up to an additional 30 days), we will notify you of the extension and the reason for it.
Under the CCPA, we will not charge you a fee for processing a reasonable number of access or deletion requests. We may charge a reasonable fee if your request is excessive, repetitive, or manifestly unfounded. We will notify you of any such fee before processing your request.
7. Children's Privacy
Our Service is not intended for individuals under the age of 18 ("Children"). We do not knowingly collect personal information from Children. If we learn that we have collected personal information from a Child without the consent of a parent or legal guardian, we will delete that information promptly. If you are a parent or legal guardian and believe your Child has provided personal information to us, please contact us at customer@eaglever.com to request deletion.
8. Links to Other Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the privacy practices, content, or terms of service of these third-party sites. We encourage you to review the privacy policies and terms of service of any third-party sites you visit, as we have no control over and assume no liability for their actions.
9. Changes to This Policy
We may update this Policy periodically to reflect changes in our practices, legal requirements, or the Service. Your continued use of the Service after the updated Policy is posted constitutes your acceptance of the revised terms. If you do not agree to the updated Policy, you must stop using the Service and delete your account (if you have one). We encourage you to review this Policy regularly to stay informed about how we protect your information.
